1. Scope and definitions
These Terms of Service (“Terms”) govern the use of the breeder.cloud platform (“platform”), an online service for professional animal breeders to manage breeding programs, litters, medical records, contracts, and waiting lists. By accessing or using the platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must refrain from using the platform.
In these Terms:
“breeder.cloud” refers to the software platform and service provided by the operator;
“Operator” means the legal entity that operates breeder.cloud, as identified in section 7 of these Terms;
“User” means any person or legal entity that registers an account or otherwise uses the platform;
“Customer” means a person who acquires animals from a user through the platform;
“Data” means any information uploaded, entered, or generated on the platform, including but not limited to animal records, medical histories, and contract details.
2. Account registration
To use breeder.cloud, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You must be at least 18 years old or have the legal capacity to enter into binding agreements.
You are responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify the operator immediately if you suspect any unauthorised use of your account.
3. Use of the platform
The platform enables users to:
Manage breeding programs and litters;
Maintain medical records and health information for animals;
Create and manage contracts with customers;
Maintain waiting lists and customer communication.
You agree to use the platform only for lawful purposes and in compliance with these Terms. You may not use the platform to store or distribute unlawful content, or to infringe the rights of third parties. The operator may suspend or terminate your account if you misuse the platform.
4. Fees and payments
Certain features of breeder.cloud may require payment. Fees, if any, will be communicated transparently before you subscribe or purchase. Payments are processed by a third-party provider, Rompslomp, which handles financial data on behalf of the operator. You agree to pay all fees associated with your selected plan, and all amounts are payable in accordance with the invoice terms.
5. User obligations
As a user, you are responsible for the accuracy and lawfulness of the data you upload. You must ensure that your use of breeder.cloud does not violate any applicable law or regulation, including data protection and animal welfare legislation. You must also obtain any necessary consents from customers before storing their personal information on the platform.
You may not attempt to reverse engineer, disrupt, or gain unauthorised access to breeder.cloud or its underlying infrastructure.
6. Intellectual property
The platform, including its software, design, text, and graphics, is the intellectual property of the operator. You acquire no ownership rights in the platform itself. You retain ownership of the data you upload. By using breeder.cloud, you grant the operator a limited, worldwide licence to process this data solely for the purpose of providing the service.
The operator claims no ownership over the animals, contracts, or other information you manage through the platform.
7. Privacy and data protection
This section constitutes the Privacy Policy of breeder.cloud. It explains how the operator collects, uses, protects, and processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Dutch law.
7.1 Controller and contact details
breeder.cloud is operated by a company registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under number 42161041, with its registered location in Zwolle, the Netherlands. This company acts as the data controller for the processing described in this policy.
7.2 Data we collect
The operator collects and processes only the data necessary to provide the platform’s services. This includes:
Account data: your name, email address, organisation name, and contact details.
Animal data: information about animals managed in breeding programs, litters, and medical records.
Customer data: information about your customers, such as names and contact details, which you enter for contracts and waiting lists.
Financial data: processed by Rompslomp for invoices and payments; the operator does not store credit card details.
Technical data: your IP address, browser type, and usage data collected through Vercel Web Analytics solely for the purpose of improving the service.
7.3 Purposes of processing
Your data is processed exclusively to:
Provide, maintain, and improve the breeder.cloud platform;
Facilitate the management of breeding programs, litters, medical records, contracts, and waiting lists;
Communicate with you about your account and service updates;
Comply with legal and fiscal obligations.
7.4 Infrastructure and subprocessors
breeder.cloud is hosted on infrastructure provided by Vercel. The operator uses Vercel Web Analytics to collect anonymous, aggregated usage statistics. Databases are hosted with Neon. DNS and content delivery network (CDN) services are provided by Cloudflare. Financial data is processed through Rompslomp. Source code repositories, which do not contain user data, are hosted at GitLab.
7.5 No sale, ads, or trackers
The operator does not sell personal data to third parties. breeder.cloud does not display advertisements and does not use tracking cookies or similar technologies for advertising purposes. Vercel Web Analytics is used only for aggregated, privacy-friendly statistics.
7.6 Data security
The operator takes appropriate technical and organisational measures to secure your data against unauthorised access, loss, or alteration. These measures include encryption in transit, access controls, and regular security reviews. Our hosting and database providers apply industry-standard security measures.
7.7 Data retention
Data is retained only as long as necessary to provide the service or to comply with applicable legal retention periods. You may request deletion of your data at any time, subject to legal obligations requiring retention.
7.8 Your rights
Under the GDPR, you have the right to:
Request access to your personal data;
Request correction of inaccurate data;
Request erasure of your data, subject to legal retention obligations;
Receive your data in a structured, machine-readable format (data portability);
Object to specific processing activities;
Lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
To exercise any of these rights, please contact the operator using the contact details provided in the platform. We will respond within the timeframe required by law.
8. Security
The operator takes reasonable steps to protect the platform and your data from unauthorised access, cyberattacks, and other threats. However, no system is completely secure. You are responsible for keeping your own devices and networks secure, and for using strong, unique passwords.
In the event of a data breach that affects your data, the operator will notify you and the relevant supervisory authority as required by applicable law.
9. Availability and liability
The operator aims to keep breeder.cloud available at all times but does not guarantee uninterrupted service. The platform may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond the operator’s control.
To the maximum extent permitted by law, the operator shall not be liable for indirect or consequential damages, including loss of profit or business opportunity, arising from the use or inability to use the platform. The operator’s total liability for any claim is limited to the amount paid by you for the service in the twelve months preceding the event giving rise to the claim.
10. Termination
You may terminate your account at any time by contacting the operator or using the account settings. Upon termination, your data will be deleted, unless you export it beforehand or unless the operator is legally required to retain certain records.
The operator may suspend or terminate your account if you violate these Terms, if your conduct endangers the platform or other users, or if required by law. In such cases, the operator will endeavour to notify you in advance, unless immediate action is necessary.
11. Changes to these Terms
The operator may update these Terms from time to time to reflect changes in the service, legal requirements, or business practices. Users will be notified of material changes by email or through the platform. Continued use of breeder.cloud after the changes take effect constitutes acceptance of the revised Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising out of or in connection with the use of breeder.cloud shall be brought before the competent court in the district of Zwolle, the Netherlands, unless mandatory law prescribes otherwise.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to apply. The operator may be contacted through the communication channels provided on the platform.
